Right to Buy

When a Council House is being purchased under The Right to Buy Scheme, the procedure is slightly simpler than for a normal purchase.

The Council will produce the documentation in standard form. The normal Searches will still be required, as will your Mortgage Offer. However, there is no formal exchange of Contracts stage involved.

Our Conveyancing Team will check the documentation that has been prepared by the Council and, if approved, will obtain your signatures to the same. The transaction will then proceed to completion on a date agreed between yourselves and the Council. You will need to ensure that your rent is paid up to the date of completion, otherwise completion cannot take place.

On the date agreed for completion, we will arrange to transfer the completion money to the Council and the property will then be transferred into your name.

After completion, we will deal with any Stamp Duty payable and also deal with the registration of your title to the property at H M Land Registry. Once the registration formalities have been completed, we will forward a copy of the H M Land Registry Property Register to you for your information.
