Powers of Attorney

There are often situations when you may need to allow somebody else to make decisions for you.

This can be done through a Power of Attorney. Our team can deal with all types of Powers of Attorney including General Powers of Attorney and Lasting Powers of Attorney.

General Powers of Attorney

A General Power of Attorney can be used to allow somebody else to act on your behalf, either in relation to a specific matter (such as to sell your property) or for a specific length of time (for example if you were to be out of the country for a period of time).

Lasting Powers of Attorney

Lasting Powers of Attorney are one of the most important documents you can prepare.  They allow those that you appoint to make decisions for you and deal with your affairs if you are ever unable to do so yourself, either due to mental or physical incapacity.  There are two different types of Lasting Power of Attorney.

  • Property and Financial Affairs
  • Health and Personal Welfare

You can make either or both of these documents.  However, you can only make a Lasting Power of Attorney if you have sufficient mental capacity to do so and so it is very important to prepare them well in advance of anything happening, in the hope that you may never need the document.

If you would like to discuss Lasting Powers of Attorney please contact our Private Client Team.

If a friend or relative has not prepared a Lasting Power of Attorney and you are concerned about whether they now have sufficient mental capacity to do so, it may be necessary for an application to the Court of Protection to be made.  Please contact our team today who can guide you through the Court of Protection process.
